Terms of Service

Pre-launch notice: these terms are pending final review by a California-licensed attorney. The version effective at the time of your purchase is the version that applies to you. By using the Service, you agree to the terms in effect on the date of your transaction.

1. What Selah Shield is

Selah Shield is an automated software service operated by Selah Web Agency ("Selah", "we", "us"). When you submit a website URL and your business information, our software runs an automated WCAG 2.1 accessibility scan using the open-source axe-core engine, generates a PDF report based on the scan output, and delivers that report to your email address.

Selah Shield is a software product, not a professional service. You are buying access to automated software output, formatted into a useful document. You are not retaining Selah as an accessibility consultant, legal advisor, web developer, or auditor.

2. What Selah Shield is NOT

The Service does not constitute and is not a substitute for:

For legal advice, consult a qualified California attorney. For comprehensive accessibility certification, retain a credentialed accessibility auditor (e.g., IAAP-certified). For remediation, contact us about our remediation services or retain a qualified web developer.

3. The report you receive

Each scan produces a PDF report containing:

  1. The findings reported by axe-core as of the scan date and time
  2. Severity classifications (Critical, Serious, Moderate, Minor) as assigned by axe-core
  3. WCAG 2.1 success criterion citations for each finding
  4. An auto-generated accessibility statement template you may publish on your website
  5. A unique report ID and timestamp

The report represents the state of the website at the moment of the scan only. Subsequent changes to your website are not reflected. Reports are not updated unless you purchase a new scan.

4. Founding member terms

Customers in the founding cohort (founders 1–50) receive the Service at no charge in exchange for the following:

  1. Within 14 days of receiving the report, you will provide Selah with a 2-sentence written response describing your experience with the Service.
  2. You grant Selah a perpetual, non-exclusive license to use your written response, your business name, and the fact of your use of the Service in marketing materials, including but not limited to website copy, advertising, and case studies.
  3. Selah will not publicly quote your written response without first sharing the intended use with you and obtaining explicit consent for that specific use.

Founders 51–100 receive the Service at $19 in exchange for permission to list their business name in Selah's customer roll. No testimonial obligation.

5. What we do with your data

We collect and store: the URL you submit, your email address, your business name, your scan results, the generated PDF report, and Stripe payment metadata. We do not share your information with third parties except service providers necessary to operate the Service (Stripe, Browserless, Postmark, Cloudflare). We do not sell personal information.

Customers may request deletion of their data at any time by emailing privacy@selahshield.com. We will delete personal information within 30 days, retaining only minimum records required for tax and legal purposes.

6. Refunds

If the scan fails to complete due to factors within Selah's control (software error, our infrastructure failure), we will rerun the scan or refund your payment in full at your option. Email support@selahshield.com.

If the scan fails because your website blocks automated scanners, is offline, or is behind authentication, we will notify you and offer either a manual retry, a refund, or credit toward a different scan target. Refunds are processed via Stripe within 5 business days.

If you are dissatisfied with the report for any reason within 7 days of delivery, contact us. We will work in good faith to resolve the issue.

7. Limitations of liability

To the maximum extent permitted by law:

  1. Selah's total liability to any customer arising from use of the Service is limited to the amount that customer paid for their most recent scan, or $49 for founding members.
  2. Selah is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost business opportunity, lost data, costs of substitute services, demand letters, lawsuits, settlements, judgments, or attorney's fees arising from claims by third parties (including persons with disabilities) against the customer.
  3. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness of scan results.
  4. Selah does not warrant that the report will identify all WCAG violations on your website, that addressing identified violations will achieve legal compliance, or that the Service will protect you from any specific legal claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Selah and its officers, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

9. Dispute resolution

Any dispute arising from your use of the Service will be resolved through binding arbitration in Sacramento, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

You waive your right to participate in class actions related to the Service.

10. Changes to these terms

We may update these terms from time to time. Continued use of the Service after a posted update constitutes acceptance of the updated terms. Material changes will be communicated to active customers via email.
